Longshore claims arise out of injuries alleged to have occurred within the course of work performed on the navigable waters of the United States, typically relating to a boat building such as at Bath Iron Works.
Experienced Representation for Complex and Challenging Cases
Longshore and harbor workers claims are cases of federal jurisdiction. This means that the claims are not heard in state court. Instead, longshore claims are decided by administrative law judges and the cases are processed through the United States Department of Labor, Office of Workers’ Compensation Programs.
Although similar in many respects to workers’ compensation claims administered by the Workers’ Compensation Board under the jurisdiction of the State of Maine, longshore claims are adjudicated under a separate statutory and regulatory framework. The claims oftentimes involve injury claims infrequently seen under the State Act such as with conditions related to exposure to asbestos.
