Attorney Marianna Fenton Hibbard Defeats Road Association Fee Claim

RKM Attorney Marianna Fenton Hibbard successfully defended landowners against a claim for road association fees. The road association in question filed suit against the property owners, demanding three years of road association fees plus attorney fees.

Attorney Fenton Hibbard argued the road association was not entitled to any such fees because it had not complied with the statutory notice and voting requirements of 23 M.R.S. § 3101.

After the hearing, the Court entered judgment for the RKM clients.
